At Guantánamo, many, including minors, have been held indefinitely without being tried. Finally, prosecutors hope to try as many as 80 of the 305 now held prisoner there. The rest may be transported to other countries or continue to be held indefinitely without trial. Defence lawyers are being ordered not to tell the identiy of witnesses to their clients or anyone else, depriving defendants of the right to face their accusers. Defence lawyers say this will hamper their abilities to provide adequate defences by making it difficult to test the truth of their testimonies.
Kuebler, a defence lawyer, says, "Instead of a presumption of innocence and of a public trial we start with a presumption of guilt and of a secret trial."
